Legal terms and conditions of the "I want my SeaDoo" draw

1.- PURPOSE OF THE DRAW

JetSkiDream, announces this free prize draw called "I want my SeaDoo". This prize draw is open to all individuals who meet the requirements stipulated in the following terms and conditions.

2.- PARTICIPANTS

The draw is open to all natural persons who meet all of the following requirements:

• Minimum age 16 years
• Participate in the "I want my SeaDoo" draw as indicated in these rules.
• Accept the rules of participation and data protection stipulated in these rules.

-JetSkiDream staff, as well as their family members up to the first degree who live with them, are not eligible to participate in the draw.

3.- PRIZES

The prize shall consist of : A SEADOO SPARK 60hp jet ski.

If, for reasons of force majeure, the prize indicated cannot be provided, it will be replaced by one of equal or greater value and characteristics.

Under no circumstances may the prize won be exchanged for its equivalent value in cash or be subject to substitution, change of dates, alteration or compensation of any kind.

Prizes do not include any services and/or expenses not described above.

4.- PROCEDURE OF THE DRAW

From 01/05/2022 at 00:00 hours until 30/10/2022 at 23:59 hours you can participate in the "I want my SeaDoo" raffle organised by JetSkidream.

To participate, the user must follow the steps below:

• Add GoPro 8 to your booking.
• Follow JetSkidream on some of its social media sites

• IG https://www.instagram.com/jetskidreamislacanela/
• FACEBOOK https://www.facebook.com/jetskidream/
• Upload Video and/or Photo GoPro 8 Experience to any of the social networks described above, tagging JetSkiDream and with the hashtags 1TP4Anyonewhois y #jetskidream. In case they were stories, go up in featured stories.

5.- WINNING RESERVATION COMMUNICATION

JetSkiDream will contact the winning reservation, and in the event that the member of the reservation who participated in the RRSS draw is a minor, the prize will be awarded to the parent or legal guardian who signed the authorisation or to the person with whom the activity was carried out as an accompanying person.

In order to be eligible for the prize, the winner must accept the prize and provide the necessary information within 3 days of the first communication, and as indicated by JetSkiDream in the same.

The information required will be personal data (name, surname, email and telephone number) and ID number.

If, for reasons beyond JetSkiDream's control, it is impossible to contact the winner within 3 days of the prize being announced via the email address provided by the winner and/or the winner does not provide all the required information, the right to the prize will expire and JetSkiDream will contact the first designated substitute.

The name of the winner who has provided the required information within the deadline given for this purpose, and who has accepted the prize and complies with the stipulations of the rules, will be communicated on JetSkiDream's RRSS and/or on www.jetskidream.com between 15/11/2022 and 31/12/2022.

JetSkiDream will contact the winning reservation, and in the event that the member of the reservation who participated in the RRSS draw is a minor, the prize will be awarded to the parent or legal guardian who signed the authorisation or to the person with whom the activity was carried out as an accompanying person.

6.- DEADLINES AND DELIVERY OF THE PRIZE

The right to withdraw the prize will expire thirty (30) calendar days from the day following the celebration of the draw and publication of the winner of the draw. Once this period has elapsed, if it has not been possible to deliver the prize for reasons not attributable to the Organiser, any right to claim the prize will lapse.

The prize will be delivered at the JetSkiDream facilities located at Paseo del Pinillo 11. 21409 Isla Canela, Ayamonte, Huelva, and the winner will be responsible for any possible expenses incurred by the transfer of the prize once it has been delivered.

7.- PUBLICITY OF THE WINNERS

The winner accepts and authorises that his/her name and surname, image and prize won may appear on the official Facebook page, TikTok and/or Instagram, on the website http://www.jetskidream.com/ or on any other commercial, advertising or media support that JetSkiDream may use in order to inform and publicise the result of the prize draw.

8. - DATA PROTECTION

JetSkiDream S.L. complies with current legislation on the protection of personal data, in particular with regard to Regulation (EU) 2016/679 on the protection of natural persons with regard to the processing of personal data and the free movement of such data. a) Data controller:

Your data will be processed and collected by JetSkiDream, with registered office at Paseo del Pinillo 11. 21409 Isla Canela, Ayamonte, Huelva.

• Purpose and legitimacy:

In relation to the personal data to which we may have access as a result of your participation in this draw will be treated, intended and used only for the management of your participation in the draw, including the subsequent contact with you in case you were the winner to proceed with the shipment of the prize.

9.- RESPONSIBILITIES

All participants in the sweepstakes understand and agree that JetSkiDream is not responsible for any errors, losses or irregularities that may occur when sending the information, caused by interference in communication or any other error or omission resulting from telecommunications problems, traffic, congestion or Internet connection, or any other cause not attributable to JetSkiDream, being liable only for damages caused by intent, gross negligence or breach of essential contractual obligations.

10.- EXCLUSION

JetSkiDream reserves the right to exclude the offender from participation without prior notice in the event of a possible violation of the rules of participation. Users who use unauthorised means (e.g. hacker tools, viruses, Trojans, etc.) will be excluded from participation. Anyone who participates on behalf of third parties (with or without their knowledge or consent) may also be excluded from participation. Participation in the sweepstakes via gaming groups, automated services or professional services is not permitted.

11.- EARLY TERMINATION

JetSkiDream reserves the right to interrupt the draw at any time without prior notice for reasons beyond its control. The organiser will be forced to take this decision for technical reasons (e.g. system viruses, manipulation or failure of hardware or software, etc.) or if for legal reasons the sweepstakes cannot be carried out according to the established rules. If the termination is due to inappropriate behaviour on the part of a participant, the organiser is entitled to claim damages against the participant.

12.- TAXES

In accordance with the Personal Income Tax Act and the Personal Income Tax Regulations, prizes awarded for participation in games or raffles whose value exceeds €300 are subject to payment on account. The amount of the payment on account shall be the amount in force at the time the prize is awarded.

The winner will be responsible for the amount corresponding to the payment on account of Personal Income Tax on the value of the prize. Likewise, the winner will be responsible for incorporating both the value of the prize and the amount of the payment on account not passed on in their Annual Personal Income Tax Return.
